{0>The Older People’s Commissioner for Wales welcomes the opportunity to respond to the consultation on the Safe Nurse Staffing Levels (Wales) Bill.<}0{>Mae Comisiynydd Pobl Hŷn Cymru yn croesawu’r cyfle i ymateb i’r ymgynghoriad ar y Bil Lefelau Diogel Staff Nyrsio (Cymru).<0} {0>Responses were also submitted to two previous consultations that were held by the member in charge, Kirsty Williams AM, which have been attached for reference.<}0{>Cyflwynwyd ymatebion hefyd i’r ddau ymgynghoriad blaenorol a gynhaliwyd gan yr aelod sy’n gyfrifol, Kirsty Williams AC. {0>As the independent voice and champion for older people across Wales, the Commissioner is supportive of any efforts made to improve the quality of care that is provided to older people in our hospitals.<}0{>Fel llais annibynnol a hyrwyddwr ar gyfer pobl hŷn ledled Cymru, mae’r Comisiynydd yn cefnogi unrhyw ymdrechion a wneir i wella ansawdd y gofal a ddarperir i bobl hŷn yn ein hysbytai.<0} {0>Older people are the largest users of the NHS in Wales, and the Welsh NHS has a duty of care to get it right for older people.<}0{>Pobl hŷn yw prif ddefnyddwyr y GIG yng Nghymru, ac mae gan GIG Cymru ddyletswydd gofal i roi chwarae teg i bobl hŷn.<0}

{0>In 2011, the Commissioner published ‘Dignified Care?’, a report into the treatment of older people in Welsh hospitals in relation to dignity and respect.<}99{>Yn 2011, cyhoeddodd y Comisiynydd adroddiad ‘Gofal gydag Urddas?’ ar sut y caiff pobl hŷn eu trin yn ysbytai Cymru mewn perthynas ag urddas a pharch. <0} {0>One of the main findings of this report was that staffing levels on wards had to better reflect the needs of older people both now and in the future.<}94{>Un o brif ganfyddiadau’r adroddiad hwn oedd bod yn rhaid i lefelau staffio ar wardiau adlewyrchu'n well anghenion pobl hŷn nawr ac yn y dyfodol. <0} {0>The needs of older people in hospital will be complex and varied, and many may be living with dementia or a cognitive impairment.<}0{>Bydd anghenion pobl hŷn mewn ysbytai yn gymhleth ac yn amrywiol, ac mae’n bosibl y bydd llawer ohonynt yn byw gyda dementia neu nam gwybyddol.<0} {0>The Commissioners, ‘Dignified Care:<}0{>Nododd adroddiad y Comisiynydd, ‘Gofal gydag Urddas:<0} {0>Two Years On’ report stated that "There is a clear link between staffing levels and the safety and quality of care on hospital wards.<}77{>Dwy Flynedd yn Ddiweddarach’ bod “Cyswllt amlwg rhwng lefelau staffio a diogelwch ac ansawdd gofal ar wardiau ysbyty.<0} {0>Routine and public reporting about the adequacy of staffing levels must be an immediate priority for the Welsh Government and the NHS."{1>fn<1}<}96{>Rhaid i adroddiadau ynghylch pa mor ddigonol yw lefelau staffio (gan y cyhoedd ac fel mater o drefn) fod yn flaenoriaeth o bwys i Lywodraeth Cymru ac i’r GIG.”{1>[1]<1}<0}

{0>Ensuring that nurse staff are able to meet these needs is complicated and requires a great deal of planning.<}0{>Mae sicrhau bod modd i staff nyrsio ddiwallu’r anghenion hyn yn gymhleth ac yn gofyn am lawer iawn o waith cynllunio.<0} {0>Staffing ratios are a useful tool to be used in monitoring staffing levels; they are a standard that act as a warning signal if this changes below a certain level.<}95{>Mae cymarebau staffio yn ddull defnyddiol i'w ddefnyddio i fonitro lefelau staffio; maent yn safon sy'n rhybuddio os bydd y niferoedd yn newid i fod yn is na lefel benodol. <0}{0>However, this must be used in conjunction with an intelligent acuity tool that calculates the level of staffing based upon the complex, and variable needs of patients in order to achieve the best outcomes for patients.<}0{>Serch hynny, mae’n rhaid defnyddio hyn ar y cyd â dull aciwtedd deallus sy’n cyfrifo’r lefel staffio ar sail anghenion cymhleth ac amrywiol y cleifion er mwyn sicrhau'r canlyniadau gorau i gleifion.<0}

{0>The emphasis at all times should be on the duty of health service bodies to facilitate and deliver staff levels that produce safe, effective, appropriate and timely care in a kind and compassionate manner, as opposed to minimum standards or the use of staffing ratios to balance the bodies finances.<}0{>Dylai’r pwyslais bob amser fod ar ddyletswydd cyrff y gwasanaeth iechyd i hwyluso a sicrhau lefelau staffio sy’n darparu gofal diogel, effeithiol, priodol a phrydlon mewn ffordd garedig a thosturiol, yn hytrach nag ar safonau isel neu ddefnyddio cymarebau staffio er mwyn bodloni sefyllfa ariannol y corff.<0} {0>Therefore it is welcome that the Bill recognises safe, rather than minimum nursing staff levels, and includes the use of acuity tools to determine safe levels.<}0{>Felly rwy’n croesawu bod y Bil yn rhoi pwyslais ar lefelau staff nyrsio diogel yn hytrach na’r lefelau isaf posibl, a’i fod yn cyfeirio at ddefnyddio dulliau aciwtedd deallus er mwyn pennu lefelau staffio diogel.<0}

 

{0>Recording staffing numbers<}0{>Cofnodi niferoedd staff<0}

{0>The Commissioner’s submission to previous consultations raised concerns that "there must be more clarity and accuracy in recording staffing numbers as currently this can include people on sick leave and those that are suspended".<}0{>Mae cyflwyniadau’r Comisiynydd i ymgynghoriadau blaenorol wedi codi pryderon o ran "bod yn rhaid sicrhau mwy o eglurdeb a chywirdeb wrth gofnodi niferoedd staff oherwydd ar hyn o bryd, gall hyn gynnwys staff sy'n absennol oherwydd salwch a staff sydd wedi'u gwahardd".<0}

{0>The Bill includes provision for the protection of ‘planned and unplanned leave’ when determining safe staffing levels, and it can be assumed that this would include those staff members on sick leave.<}0{>Mae'r Bil yn cynnwys darpariaeth ar gyfer ‘absenoldeb wedi'i drefnu a heb ei drefnu' wrth bennu lefelau staffio diogel, a gellir tybio y byddai hyn yn cynnwys yr aelodau hynny o staff sy'n absennol oherwydd salwch. <0} {0>However, further clarification on whether this would include suspended staff would be welcome, and if not, what can be put in place to ensure that they are taken into account when workforce and rota planning.<}0{>Serch hynny, byddai rhagor o eglurhad ynghylch a fyddai hyn yn cynnwys staff wedi’u gwahardd yn cael ei groesawu, ac oni fydd, beth y gellir ei roi ar waith er mwyn sicrhau y cânt eu hystyried wrth gynllunio’r gweithlu a’r rota.<0}

{0>Alongside using acuity tools to determine the number of staff that are needed to meet the needs of older people, those staff must be equipped with the right skills and must be present on the ward in the right mix.<}0{>Ochr yn ochr â defnyddio dulliau aciwtedd deallus i bennu nifer yr aelodau o staff y mae eu hangen er mwyn diwallu anghenion pobl hŷn, rhaid i'r staff hynny feddu ar y sgiliau cywir ac mae'n rhaid i’r gymysgedd gywir fod yn bresennol ar y ward.<0}

{0>Well-trained staff driven by a culture of care is essential to guarantee that patients get the best possible experience, and it is disappointing that despite the examples of excellent care that the Commissioner comes across, recent reports demonstrate that older people are still not receiving the dignified and compassionate care that they have a right to receive.<}99{>Mae staff sydd wedi'u hyfforddi'n dda a'u llywio gan ddiwylliant gofal yn hanfodol i sicrhau bod cleifion yn cael y profiad gorau posibl, ac mae'n siomedig, er gwaethaf yr enghreifftiau o ofal ardderchog y daw'r Comisiynydd ar eu traws, fod adroddiadau diweddar yn dangos nad yw pobl hŷn yn cael yr urddas a'r gofal trugarog y mae ganddynt yr hawl iddo o hyd.<0} {0>Following the Commissioner’s ‘Dignified Care?’ reports, the Welsh NHS must now build upon the recommendations set out in the ‘Trusted to Care’{1>fn<1} report, especially around  improving the skills and knowledge of staff in treating and caring for older people and delivering relationship-centred care.<}0{>Yn dilyn cyflwyno adroddiadau ‘Gofal gydag Urddas?’ y Comisiynydd, mae’n rhaid i GIG Cymru weithredu ar yr argymhellion a nodwyd yn yr adroddiad ‘Ymddiried mewn Gofal’[2], yn arbennig ynghylch gwella sgiliau a gwybodaeth staff o ran trin a gofalu am bobl hŷn a darparu gofal sy'n canolbwyntio ar berthynas.{1><1}<0}

{0>The Bill recognises that the appropriate nursing skill mix is needed alongside numbers in order to achieve safe levels and reflect patient care needs.<}0{>Mae’r Bil yn cydnabod bod angen sicrhau’r gymysgedd briodol o sgiliau nyrsio yn ogystal â niferoedd er mwyn cyrraedd lefelau diogel ac adlewyrchu anghenion gofal cleifion.<0}{0>It is also welcome that in determining and maintaining safe levels, the Bill introduces protections for staff time for induction and continuous training.<}0{>Croesewir hefyd bod y Bil, wrth bennu a chynnal lefelau diogel, yn cyflwyno cynlluniau i neilltuo amser staff ar gyfer hyfforddiant cynefino a pharhaus.<0} {0>Ensuring that nurse staff have access to training so that they can gain and maintain the skills that they need to care for older people is just one element in providing high quality care to older people in hospital.<}0{>Dim ond un elfen o ddarparu gofal o ansawdd uchel i bobl hŷn mewn ysbytai yw sicrhau bod staff nyrsio yn cael hyfforddiant er mwyn ennill a chynnal y sgiliau angenrheidiol i ofalu am bobl hŷn.<0}

{0>However it is essential that this protected time is achieved in reality, as without access to appropriately skilled staff, ensuring the numbers and mix are correct in itself will not improve patient care.<}0{>Fodd bynnag, mae’n hollbwysig bod yr amser penodol hwn yn cael ei neilltuo mewn gwirionedd, oherwydd heb staff â'r sgiliau priodol, ni fydd sicrhau’r niferoedd a’r gymysgedd gywir yn gwella gofal i gleifion. <0}

{0>The Commissioner’s submission to the previous consultations stated that leadership and the ability to make decisions, especially when the needs of patients change quickly, should form part of the debate on improving nursing standards.<}71{>Roedd cyflwyniad y Comisiynydd i’r ymgynghoriadau blaenorol yn nodi y dylai arweinyddiaeth a'r gallu i wneud penderfyniadau, yn arbennig pan fo anghenion cleifion yn newid yn gyflym, fod yn rhan o'r drafodaeth ar wella safonau nyrsio. <0}{0>Hospital staffing should be flexible so that it can adapt in response to the ever-changing needs of their patients.<}0{>Dylai staff ysbytai fod yn hyblyg er mwyn gallu addasu i anghenion eu cleifion sy’n newid o hyd.<0}{0>When difficult decisions need to be made, ward mangers need to have the power to respond and alter their staff balance accordingly.<}100{>Pan fo angen gwneud penderfyniadau anodd, mae angen i reolwyr wardiau gael y pŵer i ymateb ac i newid eu cydbwysedd staffio yn unol â hynny. <0}

{0>Ward managers have told the Commissioner that despite considerable investment in initiatives and the development of clinical leadership programmes, they are often not allowed to select the staff for the ward themselves.<}0{>Mae rheolwyr wardiau wedi dweud wrth y Comisiynydd nad ydynt yn aml yn cael dewis staff ar gyfer y ward eu hunain, er gwaethaf y buddsoddiad sylweddol mewn mentrau a'r gwaith a gyflawnwyd yn datblygu rhaglenni arweinyddiaeth glinigol.<0} {0>This limits their opportunity to assess the skills, knowledge, and the attitudes of the staff working on their wards{1>fn<1}.<}97{>Mae hyn yn cyfyngu ar eu cyfle i asesu sgiliau, gwybodaeth ac agweddau'r staff sy'n gweithio ar eu wardiau.{1>[3]<1}<0} {0>It is welcome therefore that the Bill includes the exercise of professional judgement within the staff planning process.<}0{>Mae’r Comisiynydd yn croesawu felly bod y Bil yn cyfeirio at ddefnyddio barn broffesiynol wrth gynllunio staff.<0}

 

{0>Role of nursing staff in other settings<}0{>Rôl staff nyrsio mewn lleoliadau eraill<0}

{0>The Commissioner’s recently published Review into the Quality of Life and Care of Older People Living in Care Homes in Wales, ‘A Place to Call Home?’ included significant evidence regarding the key role that the Welsh NHS and its nurses play in the quality of care and safety of older people in residential and nursing care homes.<}0{>Roedd Adolygiad i Ansawdd Bywyd a Gofal Pobl Hŷn sy’n Byw mewn Cartrefi Gofal yng Nghymru, ‘Lle i’w Alw’n Gartref?’ a gyhoeddwyd gan y Comisiynydd yn ddiweddar, yn cynnwys llawer o dystiolaeth ynghylch y rôl allweddol sydd gan GIG Cymru a'i nyrsys i’w chwarae o ran ansawdd gofal a diogelwch pobl hŷn mewn cartrefi gofal preswyl a nyrsio.<0} {0>Ensuring there are adequate numbers of nursing staff is essential but, as has been recognised above in relation to hospital wards, it is also about ensuring staff have the right skills and knowledge, the ability to draw in other services and support where required, and are provided with the time not just to undertake clinical care but also to deliver crucially important, yet often intangible compassion and kindness.<}75{>Mae sicrhau bod niferoedd digonol o staff nyrsio yn hanfodol ond, fel y nodwyd uchod o ran wardiau ysbytai, mae hefyd yn ymwneud â sicrhau bod staff yn meddu ar y wybodaeth a'r sgiliau cywir, eu bod yn gallu manteisio ar gymorth a gwasanaethau eraill lle bo'n ofynnol, a'u bod yn cael yr amser nid yn unig i sicrhau gofal clinigol ond hefyd i sicrhau trugaredd a charedigrwydd amhrisiadwy sy'n hollbwysig.<0}{0>Please see Appendix A for the relevant section of the Review.<}0{>Edrychwch ar Atodiad A i weld adran berthnasol yr Adolygiad.<0}

{0>In addition to nursing care homes, there is a large number of nurse staff working across Wales in community settings.<}0{>Yn ogystal â chartrefi gofal nyrsio, mae nifer fawr o staff nyrsio yn gweithio mewn cymunedau ledled Cymru.<0}{0>With the planned policy shift away from treatment and long stays within acute wards and towards care and treatment within the community, and also the need to better integrate health and social care services, responsive workforce planning and safe nurse staffing levels need to apply in those settings to ensure that potentially frail and vulnerable older people are receiving safe and appropriate care in all situations.<}0{>Wrth i bwyslais y polisi arfaethedig wyro oddi wrth driniaeth ac arhosiad hir mewn wardiau acíwt tuag at ofal a thriniaeth yn y gymuned, ac wrth ystyried yr angen hefyd i integreiddio gwasanaethau iechyd a gofal cymdeithasol yn well, mae angen i’r gwaith o gynllunio’r gweithlu’n briodol a sicrhau lefelau diogel o staff nyrsio fod yn berthnasol i’r lleoliadau hynny er mwyn gwneud yn siŵr bod pobl hŷn eiddil a bregus yn cael gofal diogel a phriodol ym mhob sefyllfa.<0}

{0>The Bill includes a subsection that would allow Welsh Ministers to extend the safe nurse staffing duty to ‘additional settings within the National Health Service in Wales’.<}0{>Mae’r Bil yn cynnwys is-adran a fyddai’n galluogi Gweinidogion Cymru i ymestyn y ddyletswydd i ddarparu lefelau diogel o staff nyrsio i ‘leoliadau eraill yn y Gwasanaeth Iechyd Gwladol yng Nghymru’.<0} {0>However, it is unlikely that this would support the extension of safe nurse staffing levels into nursing care home settings as these are often independently owned with placements commissioned by the Local Authority or Health Board.<}0{>Fodd bynnag, mae’n annhebygol y byddai hyn yn cynnwys ymestyn lefelau diogel staff nyrsio mewn cartrefi gofal nyrsio gan fod y rhain yn aml yn eiddo i berchennog annibynnol ac mae’r lleoliadau yn cael eu comisiynu gan yr Awdurdod Lleol neu’r Bwrdd Iechyd. <0}{0>This is disappointing as there are vulnerable older people living in these settings who receive care and treatment from nurse staff on a daily basis.<}0{>Mae hyn yn siomedig gan fod pobl hŷn fregus yn byw yn y lleoliadau hyn, sy’n cael gofal a thriniaeth gan staff nyrsio bob dydd.<0}

{0>Furthermore in the context of community based nursing, it is unclear from the Bill whether the provision of nursing care within someone’s own home would qualify as an ‘additional setting within the National Health Service in Wales’.<}0{>Hefyd, yng nghyd-destun nyrsio yn y gymuned, nid yw’r Bil yn ei gwneud yn glir p'un ai a fyddai darparu gofal nyrsio yng nghartref rhywun yn cael ei ystyried fel ‘lleoliad ychwanegol o fewn y Gwasanaeth Iechyd Gwladol yng Nghymru’.<0}

{0>The requirement that ‘each health service body in Wales must publish an annual report’ will be a method through which compliance against the safe nurse staffing levels duty can be judged, and is to be welcomed.<}0{>Bydd y ffaith ei bod yn ofynnol i ‘bob corff y gwasanaeth iechyd yng Nghymru gyhoeddi adroddiad blynyddol’ yn ddull y gellir ei ddefnyddio i bwyso a mesur lefelau diogel staff nyrsio, a chaiff hyn ei groesawu.<0}

{0>For example, as stated above -, ‘it is essential that this protected time (for staff induction and training) is achieved in reality...’.<}0{>Er enghraifft, fel y nodir uchod – ‘mae’n hollbwysig bod yr amser penodol hwn (ar gyfer cynefino a hyfforddi staff) yn cael ei neilltuo mewn gwirionedd...’<0} {0>The annual report would therefore present an opportunity to state if this was the case, and if not, why not.<}0{>Felly byddai’r adroddiad blynyddol yn gyfle i nodi p’un ai a ddigwyddodd hyn ai peidio, ac os na, pam hynny.<0}
